These Terms of Use govern your access to and use of the Trufocus.photos website, the Trufocus mobile application, our galleries, booking flows, and related services.

By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.

1. About the Service

Trufocus provides event photography, media delivery, gallery access, inquiry handling, booking coordination, and related digital experiences.

2. Eligibility and Acceptable Use

You agree to use the services only for lawful purposes and in a way that does not infringe, misuse, disrupt, or interfere with our systems, content, users, or operations.

• do not attempt unauthorized access to any account, gallery, admin area, device, or system
• do not upload or transmit malicious code, harmful content, or illegal material
• do not scrape, copy, resell, reverse engineer, or misuse the services beyond permitted use
• do not impersonate another person or submit false booking, payment, or support information

3. Accounts, Galleries, and Access

If the website or mobile app provides account, gallery, or personalized access features, you are responsible for maintaining the confidentiality of your access credentials and for activities occurring through your access.

We may suspend, restrict, or revoke access where we reasonably believe use is unauthorized, abusive, unlawful, insecure, or inconsistent with these Terms.

4. Bookings and Client Information

When you submit an inquiry, request a quote, confirm a booking, or share event details, you agree that:

• the information you provide is accurate and complete
• we may contact you regarding the requested services
• quotes, service availability, scheduling, and deliverables may depend on event details, logistics, and confirmation steps
• additional commercial terms may be set out separately in proposals, invoices, confirmations, or service agreements

5. Mobile App Use

The Trufocus mobile app may include features such as gallery viewing, uploads, notifications, communication tools, and event-related workflows. Certain features may depend on device compatibility, connectivity, permissions, or service availability.

• you remain responsible for data charges, connectivity, and device security
• you must use the app only on devices and accounts you are authorized to use
• features may change, be added, restricted, or removed over time

6. User Content and Uploaded Material

If you upload, submit, share, or transmit photos, videos, text, feedback, or other material through our services, you represent that you have the rights and permissions needed to do so.

• you retain ownership of content you lawfully own
• you grant us a limited right to host, process, store, display, transmit, back up, and manage that content as needed to provide the services
• we may remove content that violates law, rights of others, or these Terms

7. Photography, Media Rights, and Portfolio Use

Unless otherwise agreed in writing, content created in connection with our services may be used for operational delivery, editing, curation, archival purposes, and portfolio or promotional display.

If a client requests restrictions on public display or promotional use, such requests should be communicated clearly and in advance where possible. We will review and honor agreed restrictions reflected in the applicable service arrangement.

8. Intellectual Property

The website, mobile app, design, branding, logos, text, graphics, software elements, and service content are owned by or licensed to Trufocus, except where third-party rights apply.

You may not copy, modify, distribute, republish, frame, reproduce, or exploit our content except as expressly permitted by law or by written consent.

9. Third-Party Services and Links

Our services may contain links to third-party sites, embedded media, payment tools, messaging tools, analytics services, cloud infrastructure, or other external services. We do not control those third parties and are not responsible for their independent terms, security, availability, or privacy practices.

10. Service Availability and Changes

We may update, improve, suspend, discontinue, or modify any part of the website, mobile app, gallery workflows, or related services at any time, with or without notice, where reasonably necessary.

We do not guarantee uninterrupted availability, error-free operation, or permanent preservation of any feature, gallery, or media-delivery workflow unless explicitly agreed in writing.

Your use of the services is also governed by our Privacy Policy, which explains how we collect, use, store, and disclose information.

12. Disclaimers

Where liability cannot be excluded, it will be limited to the maximum extent permitted under applicable law and, where relevant, to the amount paid for the specific service giving rise to the claim.

14. Indemnity

You agree to indemnify and hold Trufocus harmless from claims, liabilities, damages, losses, and expenses arising from your misuse of the services, your content, your violation of these Terms, or your infringement of any rights of another person or entity.

15. Termination

We may suspend or terminate access to the services if we reasonably believe you have violated these Terms, created security risk, acted unlawfully, or misused the services. Clauses that by nature should survive termination will continue to apply.

16. Governing Law and Disputes

These Terms are governed by applicable laws of the jurisdiction in which Trufocus operates, unless mandatory law requires otherwise. Any disputes will be handled through the appropriate courts or legal forums with jurisdiction over the matter, subject to applicable law and any written client agreement.
